SL Bar Association

SL Bar Association

[09:55] Tim Faith (yoss.kamachi): we were just discussing membership and finances
[09:55] Hector Cuprill Jr Esquire (hectorcuprilljresquire): Very well indeed. Carry on.
[09:55] Tim Faith (yoss.kamachi): but those probably aren't very good ice breakers for meetings
[09:55] Ellen (ellen.ireland): I am looking forward to the day when depositions and even court hearings could be conducted in virtual spaces like this. Someday.
[09:56] Ellen (ellen.ireland): But we would probably want to make sure the animations are more businesslike for that purpose.
[09:56] Elizabeth (elizabethesq): They are already conducting business meetings in places like this.
[09:56] Tim Faith (yoss.kamachi): any objection to my paying sam L30,800 for the back rent for the office, and L3,850 for Feb 2013?
[09:56] Ellen (ellen.ireland): I do seem to be fussing with my hair rather a lot. :-)
[09:56] Elizabeth (elizabethesq): lol
[09:57] Tim Faith (yoss.kamachi): hi starlight
[09:57] Elizabeth (elizabethesq): No objections.
[09:57] Ellen (ellen.ireland): Hello Starlight
[09:57] Hector Cuprill Jr Esquire (hectorcuprilljresquire): no objection here
[09:57] Elizabeth (elizabethesq): Hello Starlight!
[09:57] Hector Cuprill Jr Esquire (hectorcuprilljresquire): hello starlight
[09:57] Sam Courtois. Esq. (sam4.courtois): Hello Zenitram
[09:57] Starlight Darkmatter: hi :)
[09:57] zenitram (rsmartinez): hello
[09:57] Sam Courtois. Esq. (sam4.courtois): Hello Starlight!~
[09:57] Agenda Faromet: No objection. But...since it is 10 now, shall we move into the next room so everyone can sit?
[09:57] Elizabeth (elizabethesq): Hi Zenitram!
[09:58] Tim Faith (yoss.kamachi): i agree, let's do that
[09:58] Tim Faith (yoss.kamachi): sam, i will pop out and make that transfer for rent
[10:01] Sam Courtois. Esq.: As was noted beofre some of you arrived, the last lectures by Tim and Agenda has been posted on YouTube
[10:01] Ellen: I did miss that info
[10:01] Starlight Darkmatter: nice :) what are the links?
[10:02] Sam Courtois. Esq.: I have given an interview to the Washington Lawyer, which will be in the April Issue.
[10:02] Elizabeth: :-)
[10:02] Starlight Darkmatter: :)
[10:02] Ellen: Will that be available online?
[10:02] Hector Cuprill Jr Esquire: Congrats
[10:02] Sam Courtois. Esq.: We have been contacted by a free-lance reporter who apparently wants to do an article.
[10:02] Sam Courtois. Esq.: Now Ellen's FaceBook apage!
[10:03] Sam Courtois. Esq.: Wow!
[10:03] Ellen: I can create a separate FB page for the SLBA if we don't already have one.
[10:03] Tim Faith: we have two
[10:03] Ellen: I was planning to post to my own wall, but .... ah, thanks Tim
[10:03] Tim Faith: however, we need to do something about that
[10:03] Sam Courtois. Esq.: Yes, we do, but they need to be publicized.
[10:04] Sam Courtois. Esq.: I am not sure that we have all that many FB friends, do we?
[10:04] Ellen: I practically live on Facebook these days, so anything that I can do to help, I would be glad to do
[10:04] Tim Faith: no - there are about 25 fans
[10:04] Starlight Darkmatter: me too
[10:04] Sam Courtois. Esq.: Excellent.
[10:04] Ellen: We can do better than that :-)
[10:04] Tim Faith: Geri is the owner of one of these pages - perhaps we can coordinate with her?
[10:05] Tim Faith: if you guys have some time to help - that would be awesome and incredibly welcome help
[10:05] Agenda Faromet: For those who wanted the link to the video of the presentation in January, it's here: http://www.youtube.com/watch?v=y8pbWxf_cJs
[10:05] Tim Faith: i also put that on our Ning site this afternoon
[10:05] Ellen: I just popped over to FB and did a search of "Second Life Bar Association" and the page did not show up on search
[10:06] Sam Courtois. Esq.: We do havce a lot of tools at our disposal, and since supplementing the membership roster is my primary objective, I hope you will all reach out to others.
[10:06] zenitram: search "SL Bar Association" instead on FB
[10:06] Elizabeth: Thanks for the link.
[10:06] Sam Courtois. Esq.: Yes, we must be careful. "Second Life" is not a part of our name -
[10:07] Sam Courtois. Esq.: LL found that objectionable.
[10:07] Sam Courtois. Esq.: SL is the way we worked around that.
[10:07] Ellen: OK, two pages, one with 25 likes, one with 14
[10:08] Sam Courtois. Esq.: Well, get all your FB friends to like out pages.
[10:08] Sam Courtois. Esq.: our.
[10:08] zenitram: should have one FB page ... suggest coordinating between people who put both up
[10:08] Ellen: Yes, that is what I was about to say - no reason for two
[10:09] Ellen: Additional people can be added as page managers so nobody feels left out
[10:09] Tim Faith: I agree. I think the other one was setup by Kate Fitz
[10:09] Tim Faith: way back in the day
[10:09] Tim Faith: https://www.facebook.com/pages/SL-Bar-Association/44288107757?ref=t...
[10:09] Sam Courtois. Esq.: I don't want to discourage anyone if we can avoid it.
[10:09] Hector Cuprill Jr Esquire: The good thing about SL is that we are prepared by not assoc. directly with Second Life in the event we have to move to Open Sim. So SL by itself can be carried to another virtual world just in case.
[10:10] Sam Courtois. Esq.: Interesting point.
[10:10] Sam Courtois. Esq.: Hector - I was wondering if you would be willing to share with us a little bit about your Legal Practice?
[10:10] Sam Courtois. Esq.: Obviously, you are into IP.
[10:11] Hector Cuprill Jr Esquire: I am in a Small Town. I am a general practitioner. Mostly Personal Injury Family Law, and Personal Injury (plaintiff's)
[10:11] Hector Cuprill Jr Esquire: Deland, FL (where Stetson University is). It's very cute.
[10:11] Sam Courtois. Esq.: Excellent.
[10:11] Ellen: Hector, sounds like me, a small family law practice in upstate NY here (Ellen Ross)
[10:12] zenitram: might not be a bad idea to go around the room and make intos
[10:12] zenitram: intros
[10:12] Hector Cuprill Jr Esquire: sounds good!
[10:12] Ellen: Guess I've done mine already, who's next? :-)
[10:12] Sam Courtois. Esq.: [10:12] Sam Courtois. Esq.: Excellent point
[10:12] Sam Courtois. Esq.: Elizabeth, you're next
[10:13] Hector Cuprill Jr Esquire: BTW, I am a 3rd Gen "Smart Man." Grandpa and Daddy are lawyers too. :D
[10:13] Sam Courtois. Esq.: Hello Juris.

[10:14] Juris Amat: Hi sorry about that...1
[10:14] Hector Cuprill Jr Esquire: :D
[10:14] Juris Amat: how embarrassing...

[10:19] Agenda FarometAgenda Faromet laughs
[10:19] Ellen: Not sure if I am recovering yet :-)
[10:19] Hector Cuprill Jr Esquire: :D
[10:19] Sam Courtois. Esq.: Zenitram?
[10:20] zenitram: I'm a lawyer licensed in MO and KS (RL name Robin Martinez), with Martinez Madrigal & Machicao, a small firm in Kansas City. My practice areas are mainly business and real estate, with a big emphasis on community economic development, tax credit financing, and corporate governance.
[10:20] zenitram: I go by Zen for short in SL :)
[10:20] Sam Courtois. Esq.: ok Zen, thank you.
[10:20] Sam Courtois. Esq.: Juris?
[10:21] Sam Courtois. Esq.: While she is thinking, Daniel, can you introduce yourself,?
[10:22] Juris Amat: Wow that was fast...Im Juris. My rl name is Tamiko Franklin. Im licensed in Massachusetts and Im a qualified UK solicitor. I founded the VIPO and have been active in SL for quite some time .

[10:22] DanielPerry Laa: Daniel Perry, Orlando Atty; computer law ... former SL Bar Pres.
[10:22] Tim Faith: is everyone a member on the Ning website for the SLBA?
[10:23] Tim Faith: if not, would you be so kind as to join: http://slbarassn.ning.com/
[10:23] Ellen: I was years ago, but I would have to go back to see. I probably joined as "Siobhan Wycliffe," one of my alts
[10:23] Juris Amat: I think I was a looong time ago Im not sure i still have good login info.
[10:23] Tim Faith: do you get messages from it?
[10:23] Juris Amat: no
[10:24] Hector Cuprill Jr Esquire: I joined the Ning I believe and opened a profile.
[10:24] Tim Faith: ellen, don't see that alt on the site
[10:24] Ellen: I'm resetting my password and will get back in. Thanks for the reminder.
[10:25] Tim Faith: i don't see you either juris
[10:25] Tim Faith: did you use another name way back then?
[10:25] Sam Courtois. Esq.: My RL name is J P Tangen, I practice mining law in Anchorage Alaska. My interest in SL is based upon my belief that this is the platform of the future, especially for people living in remote locations.
[10:26] Ellen: Amen to that.
[10:26] Hector Cuprill Jr Esquire: I agree, I work from home.
[10:26] Sam Courtois. Esq.: Gello Garcie!
[10:26] Ellen: Hi Gracie
[10:26] Hector Cuprill Jr Esquire: hello Gracie
[10:26] Sam Courtois. Esq.: Welcome.
[10:26] Gracie Selona: Hello All, sorry for the entrance
[10:26] Hector Cuprill Jr Esquire: No, it was impressive.
[10:26] Sam Courtois. Esq.: We were just going around the room introducing ourselves.
[10:27] Sam Courtois. Esq.: Would you like to say a few words about yourself?
[10:27] Juris Amat: Nope Time same name. Odd.
[10:27] Juris Amat: Tim
[10:27] Gracie Selona: Hello Everyone...I'm Gracie Selona, FKA Quillen McClure in SL
[10:28] Starlight Darkmatter: I have a profile on the ning.
[10:28] Hector Cuprill Jr Esquire: Welcome
[10:28] Starlight Darkmatter: Hi Gracie
[10:28] Gracie Selona: I'm a real estate paralegal in RL. Not an attorney
[10:28] Hector Cuprill Jr Esquire: The real power of attorney
[10:28] Sam Courtois. Esq.: Gracie is going to give us a program on rea estate in RL and SL later on this spring, as I recall.
[10:29] Gracie Selona: But am curious about IP law and thought this would be a nice place to meet people and learn some new things
[10:29] Ellen: OK, back in to the Ning - I used my real name there. Ellen S. Ross. Welcome, Gracie
[10:29] Sam Courtois. Esq.: What date will that be Gracie?
[10:29] zenitram: Gracie - do you focus on commercial or residential real estate?
[10:29] Gracie Selona: May..something...I'm actually hoping you can tell me
[10:30] Gracie Selona: I've done both, but currently am working in residential...coordinating mobile closings
[10:30] Sam Courtois. Esq.: It is probably in the transcript from the last meeting on the Ning.,
[10:30] Sam Courtois. Esq.: Anyhow, thank you Zen for suggesting introductions.
[10:31] Sam Courtois. Esq.: it is always a good thing to do.
[10:31] Sam Courtois. Esq.: In addition to Gracie's program in May, we will be having programs from Lyra and Geru in March and April.
[10:32] Sam Courtois. Esq.: We will need to program other presentations for the rest of the year, so if you are willing, I will ask you to consider making a presentation.
[10:32] Sam Courtois. Esq.: I beleive these presentations are the highlight of the Associations' offerings.
[10:33] Starlight Darkmatter: True, and the CLE offerings
[10:33] Ellen: Has anyone done something about interstate issues in family law?
[10:33] Sam Courtois. Esq.: Also, I would like to remind everyone that we have an on-going credentialing program.
[10:33] Sam Courtois. Esq.: Welcome Soro.
[10:34] Ellen: Hi Soro
[10:34] Elizabeth: Hello Soro!
[10:34] Soro Dagostino: Hello all, sorry to be late.
[10:34] Sam Courtois. Esq.: Credentialing is a useful tool for people who wish to make SL an adjunct to their RL practice.
[10:34] Agenda Faromet: I don't believe we have any CLE offerings through SLBA.
[10:34] Juris Amat: Its good to hear that the CLEs are still happening. Im interested in putting one on..
[10:35] Juris Amat: Has anyone contacted Cat about that?
[10:35] Sam Courtois. Esq.: I recommend that people get credentialed if appropriate to their practice.
[10:35] Juris Amat: Oh ok
[10:35] Elizabeth: I think that is a good idea.
[10:35] Sam Courtois. Esq.: Juris, can we get you to make a presentation?
[10:35] Starlight Darkmatter: Agenda, we had one before on trademarks and I saw there is another one coming up for Health law
[10:36] Ellen: Sam, if you would remind us - there is a fee for credentialing, as I recall - how much was it?
[10:36] Agenda Faromet: It would be a good idea, but offering CLEs in multiple states is very difficult without sponsorship.
[10:36] Hector Cuprill Jr Esquire: Working on learning about interstate and Int'l (Hague Treaty) issues on Family Law. I have an issue of a friend who's wife kidnapped his kids to the Ukraine. As far as intersate and family law, I have the issue of relocation from Fl to other states and how you have to jump hurdles.
[10:36] Sam Courtois. Esq.: Yes Lyra will speak on health law ans taxes on the 4th.
[10:36] Ellen: Hector, maybe you and I could work together on a presentation.
[10:36] Sam Courtois. Esq.: second sorry.
[10:36] Agenda Faromet: ....Is Lyra actually offering CLE credits in multiple states? If so, how?
[10:36] Soro Dagostino: I credentialed back when we started the process.
[10:36] Juris Amat: The SLBA used to offer CLEs using a California accredidation
[10:36] Soro Dagostino: 500L$
[10:37] Ellen: Thank you, Soro
[10:37] Soro Dagostino: Never used it.
[10:37] Tim Faith: Yes, Soro, you are on the list: http://slbarassn.ning.com/forum/topics/credentialed-listing-slba-me...
[10:37] Agenda Faromet: Right, I know. I looked into doing that again, and talked to the California State Bar about it. They told me that we could offer CLE credits in California, but not in other states.
[10:37] Hector Cuprill Jr Esquire: That will be a good idea. I will need to get better at it. Many folks from Puerto Rico are settling in Central FL and they have a ton of questions. So, it will help me a lot.
[10:37] Sam Courtois. Esq.: Cat was good, becasue she ws in the business.
[10:38] Juris Amat: right
[10:38] Elizabeth: I think that is a good idea to have a presentation covering those issues.
[10:38] Juris Amat: California is better than nothing
[10:38] Tim Faith: credentialing is L2750.
[10:38] Sam Courtois. Esq.: Getting sertified in multiple jusridictions is a monster, but a lot of places will accept CA certification.
[10:39] Ellen: Tim: Ah, thank you. The L500 is just SLBA dues, then.
[10:39] Agenda Faromet: I'm getting very confused right now -- there are several conversation threads going on and it's hard to follow all of them.
[10:39] Elizabeth: Me too.
[10:39] Sam Courtois. Esq.: LOL
[10:39] Juris Amat: me 3
[10:40] Sam Courtois. Esq.: Sorry.
[10:40] Sam Courtois. Esq.: I changed subjects too quickly. My bad.
[10:40] Sam Courtois. Esq.: Programs.
[10:40] Hector Cuprill Jr Esquire: Me 4 with getting verified. Too. I have the paper work filled out. So you know it is me just a little heftier in RL. :D
[10:40] Sam Courtois. Esq.: Anyone else want to say anything about programs.
[10:40] Agenda Faromet: Could we talk for a bit about CLE certification?
[10:41] Sam Courtois. Esq.: We ahve three in the pipeline and need more.
[10:41] Sam Courtois. Esq.: CLE certification.
[10:41] Sam Courtois. Esq.: Let's discuss that.
[10:41] Sam Courtois. Esq.: Anyone have anything on that subject to add.
[10:41] Sam Courtois. Esq.: Agenda?
[10:41] zenitram: a lot of effort to pull that off ... it's on a state-by-state basis
[10:42] Hector Cuprill Jr Esquire: We used to do the CLE's inhouse here in FL when i was w/ the Public Defender's for 4 1/2 years. It worked very well.
[10:42] Agenda Faromet: So...Lyra is offering CLE certification /in California/ for her upcoming presentation, and that's sufficient for most people? So it would be okay for most people if I were to offer CLE certification /in California/ for presentations I offer?
[10:42] Sam Courtois. Esq.: Yes.
[10:42] Starlight Darkmatter: I went to one on trademarks and the internet awhile ago and got the certificate. It was very good. I am looking forward to the one on Health.
[10:42] Sam Courtois. Esq.: At least it is a start.
[10:42] Hector Cuprill Jr Esquire: We could even all sit and roll an MP4 and at the end we log in the credits.
[10:43] Hector Cuprill Jr Esquire: Many ways it can be done. Very interesting.
[10:43] Sam Courtois. Esq.: I know in Washington, where I am also licensed, it is relatively easy to get a program approved, but you need to have the details of the program in advance.
[10:43] zenitram: KS won't even you give you credits for teleconferences ... SL would blow their minds
[10:44] Hector Cuprill Jr Esquire: :D
[10:44] Tim Faith: right - some want your materials to review before approving the program for CLE
[10:44] Agenda Faromet: Okay. That's good to know. In that case, I'll talk to the State Bar and see if I can get certification for the upcoming ones.
[10:44] Ellen: If we put together a video, I can check with lawline.com where I get my online CLE credits to find out how to get listed with them
[10:44] Sam Courtois. Esq.: Excellent.
[10:45] Hector Cuprill Jr Esquire: Hello Suemoon
[10:45] Ellen: Hi Suemoon
[10:45] Sam Courtois. Esq.: Agenda, when is your next presentation going to take place?
[10:45] Tim Faith: perhaps we could have a group that can work on CLE - I think it is a good idea for future presentations
[10:45] Sam Courtois. Esq.: Hello SueMoon.
[10:45] Suemoon Magic: Hi sorry I'm late
[10:45] Agenda Faromet: I don't have another one scheduled. The rest of this year is really busy for me -- I have two webinars coming up for the State Bar and two presentations at the ABA Annual Meeting, so I'm pretty booked.
[10:45] Juris Amat: Hmm this is interesting because my program (i believe I did need to submit materials) was approved for CLE in California but not because iM LICENSED THERE...AGINA i think the company run by Cat held the accreditation. Is that possible?
[10:45] Sam Courtois. Esq.: Do we have any volunteers?
[10:45] Tim Faith: glad you are here
[10:46] Hector Cuprill Jr Esquire: Ok I will talk to the Florida Bar Monday
[10:46] Ellen: If we can work on the CLE stuff through Facebook rather than having to log in to SL, I'm in.
[10:46] Tim Faith: juris - yes - it is possible. some of these states will credential an association rather than individual programs
[10:46] Agenda Faromet: Juris: that's correct. The reason Cat was able to offer CLE was through her company.
[10:46] Juris Amat: I volunteer to put one on...I ve been developing aprogram in odr with a couple of other organizations
[10:46] Hector Cuprill Jr Esquire: or should I contact the ABA?
[10:46] Tim Faith: hector- probably FL first
[10:47] Hector Cuprill Jr Esquire: ok, deal
[10:47] Juris Amat: hmmm i'll look into that in Mass
[10:47] zenitram: ABA has staff that simply interfaces with each state to get the certification through
[10:47] Sam Courtois. Esq.: Juris - when would you like to schedule it? June?
[10:47] zenitram: unless they'd be willing to do it for us
[10:48] Juris Amat: June is fine Sam. Is anyone here into machinima? or at least has screen capturing capability?
[10:48] Sam Courtois. Esq.: Well, even if some of us are ignorant of the subject, it would be wonderful to learn about it.
[10:48] Ellen: There's a program for that but I don't have it installed .... trying to remember the name ....
[10:48] Sam Courtois. Esq.: June it is -
[10:49] Elizabeth: I have screen capture ability. Camtasia.
[10:49] Sam Courtois. Esq.: What shall we put down for the working title?
[10:49] Juris Amat: awesome. and good to know. Thanks Elizabeth
[10:49] Ellen: I think we're talking about full motion capture rather than stills, correct?
[10:49] Elizabeth: yes
[10:49] Starlight Darkmatter: I have published a best practice guideline on machinima, and also was quoted in a new book about machnima.
[10:49] Agenda Faromet: http://wiki.secondlife.com/wiki/Movie_Recording
[10:49] Elizabeth: That's great Starlight!
[10:49] Sam Courtois. Esq.: LOL - lots of material!
[10:49] Ellen: We have an expert among us!
[10:49] Starlight Darkmatter: Let me find the links for you
[10:50] Juris Amat: Lets say... Online resolution of IPR disputes
[10:50] Juris Amat: Excellent.
[10:50] Sam Courtois. Esq.: Excellent.
[10:50] Ellen: WeGame was the one I was trying to remember. But I see there are numerous others.
[10:50] Juris Amat: @ Starlight
[10:50] Sam Courtois. Esq.: Tim, can you put that on the Ning, please?
[10:51] Sam Courtois. Esq.: OK-
[10:51] Sam Courtois. Esq.: anything more on CLE?
[10:51] Sam Courtois. Esq.: once-
[10:51] Tim Faith: done
[10:51] Sam Courtois. Esq.: twice
[10:51] Sam Courtois. Esq.: ok
[10:51] Sam Courtois. Esq.: Credentialing?
[10:51] Sam Courtois. Esq.: Anything on that?
[10:51] Tim Faith: I've updated the website
[10:51] Juris Amat: Terrific @ Starlight.
[10:51] Tim Faith: with the credentialing information I have & the process
[10:52] Soro Dagostino: I have to admit that I have a faulty memory.
[10:52] Tim Faith: I also adjusted the pay box downstairs so I get emails if anyone pays for credentialing
[10:52] Soro Dagostino: It did cost the money Tim says.
[10:52] Sam Courtois. Esq.: I encourage people to apply.
[10:52] Hector Cuprill Jr Esquire: That's good news.
[10:52] Tim Faith: besides that, does anyone have thoughts on what else we might do with this process?
[10:53] DanielPerry Laa: Which book re Machinima, Starlight?
[10:53] Sam Courtois. Esq.: We should be able to put together a directory of credentialed attorneys.
[10:53] Tim Faith: yes, that is on our website now, sam
[10:53] Tim Faith: http://slbarassn.ning.com/forum/topics/credentialed-listing-slba-me...
[10:53] Sam Courtois. Esq.: Can we psot that somewhre her in the office?
[10:53] Sam Courtois. Esq.: Agenda, perhaps you could help withthat?
[10:54] Elizabeth: Perhaps we can add a notecard or copyable "book" in the library of it?
[10:54] Elizabeth: Or on the coffee table?
[10:54] Tim Faith: that would be great
[10:54] Sam Courtois. Esq.: It should be readily available for any visitors to review.
[10:54] Sam Courtois. Esq.: Let us "advertize" our services.
[10:55] Sam Courtois. Esq.: Anything else on that subject?
[10:55] Tim Faith: would anyone be interested in offering a "law clinic" here in SL?
[10:55] Agenda Faromet: There was always a reason we didn't do that before, though. Don't we get in trouble with the ABA's ethical rules on referrals?
[10:55] Agenda Faromet: I mean, because you're paying for inclusion...
[10:55] Sam Courtois. Esq.: No referrals.
[10:55] Tim Faith: we are a nonprofit now, so we can be a referral service
[10:55] Sam Courtois. Esq.: just a list of credentialed individuals.
[10:55] Soro Dagostino: Speaking of which . . .
[10:55] Hector Cuprill Jr Esquire: Mostly you would need clearing from the bar as far as for the content of your add. Some bars require a payment.
[10:55] Tim Faith: but a "law clinic" could be just for general questions, rather than legal advice
[10:56] Elizabeth: You aren't paying to be included, you are paying to be checked out as a credentialed attorney instead of just osmeone on SL who says they are an attorney.
[10:56] Sam Courtois. Esq.: Exactly.
[10:56] DanielPerry Laa: doubt seriously any bar association even has a clue WHAT SL is- LOL!
[10:56] Ellen: :-)
[10:56] Sam Courtois. Esq.: No referrals, just a list.
[10:56] DanielPerry Laa: other than S Bar Assoc, of course
[10:56] DanielPerry Laa: SL Bar
[10:56] Sam Courtois. Esq.: Anything else?
[10:56] Agenda Faromet: Are you sure? I mean, that's why we never posted a listing of SLBA attorneys here in the office. We talked about it for years, and we always ran up against the ethics rules.

[10:57] Sam Courtois. Esq.: Soro - you were going to look into our IRS classification.
[10:57] Sam Courtois. Esq.: Do you ahve anything to report on that subject?
[10:57] DanielPerry Laa: I don't recall the ethics discussion but probably should review ethics anyway.
[10:58] Sam Courtois. Esq.: DAniel, do you have any insights as to what the ethics issues might be?
[10:58] Sam Courtois. Esq.: Would you be willing to look into it?
[10:58] Soro Dagostino: At the moment, our State papers say 501(c)(3) -- the IRS held us to a (c)(6) -- so we have some fixing to do.
[10:59] DanielPerry Laa: I don't recall the ethics discussion but probably should review ethics anyway.
[10:59] DanielPerry Laa: Considering the supreme court's of every state are in flux on social media, we should review again
[10:59] zenitram: no way we'd qualify as a c3 ... would have to be a c6
[10:59] Elizabeth: Not sure. Just something to look into. I was just clarifying that we aren't paying for the sole purpose of a listing. In Sl, we are really paying to be assured we are legitimate attorneys with avatars on SL. A list of attorneys isn't always considered advertising or a referral. I think it just depends on how it is done.
[11:00] Soro Dagostino: I agree
[11:00] Juris Amat: Same here. Back in the early days everything we did in here was an ethical question so I wouldnt be surprised if it were framed in that way but its worth looking onto agina regardless
[11:00] Soro Dagostino: But that is how it was done.
[11:00] zenitram: did the IRS issue an exemption letter?
[11:00] Agenda Faromet: I know that in California, there's just been a ruling stating that ethics on social media are just the same as ethics anywhere else (e.g., you can't call yourself a "specialist" on LinkedIn unless you actually are).
[11:01] Soro Dagostino: For (c)(6) -- from what I have been told.l
[11:01] Elizabeth: The next question then is if SL is the same as Social Media.
[11:02] Hector Cuprill Jr Esquire: More like Chat
[11:02] DanielPerry Laa: One issue is whether the credentialing is tantamount to a communication (defined as info regarding possible employment)
[11:02] Sam Courtois. Esq.: Well, we are getting into multiple subjects again.
[11:02] Ellen: This will be a fun transcript to read later. :-)
[11:02] Juris Amat: (c)(6) thats right. Ive never seen the exemption letter but i assume Lex has a copy
[11:02] DanielPerry Laa: SL will be treated the same as social media by those lawyers, judges, bar consel who are in a fog generally
[11:03] DanielPerry Laa: counsel
[11:03] Sam Courtois. Esq.: Let's talk about the ethics of posting the names of credentialed attorneys.
[11:03] Hector Cuprill Jr Esquire: The FL Bar says that if we give legal advice in a chatting scenario we create a relationship of ATTY Client. So, one should give the proper disclosures in the event you don't want that relationship to attach.
[11:03] Sam Courtois. Esq.: No one is giving legal advice on SL -
[11:03] Hector Cuprill Jr Esquire: from what I read into it
[11:04] DanielPerry Laa: Hector - that rule hs always been the same ... even in virtual or party context
[11:04] Sam Courtois. Esq.: Taht would be crazy.
[11:04] Juris Amat: i think that it should only pose a problem in terms of liability and in the event that some bar has strict advertising regs
[11:04] zenitram: how does publishing a list differ from any bar association listing things like committee members?
[11:04] Sam Courtois. Esq.: If you want to give someone legal advice, go off line.
[11:04] Juris Amat: when I say liability I mean that the posting of the name may be seen as a kind of vouching for...which may come back to bite the organization
[11:04] Hector Cuprill Jr Esquire: Agree with the publishing of our names, no problem there. It's like a Rotary Club
[11:04] Agenda Faromet: Well, let me put it this way. Would I have to pay money to get listed as an SLBA attorney? Yes. That sounds like a money-for-referral to me. Zenitram: because I don't have to pay money to get listed as a committee member.
[11:05] DanielPerry Laa: list is ok but if you list phone number, for example, the bar could believe that you are seeking employment
[11:05] DanielPerry Laa: same with credentialing
[11:05] Sam Courtois. Esq.: I don't agree.
[11:05] DanielPerry Laa: my point is simply needs review
[11:05] Juris Amat: i think with a carefully worded disclaimer iot would perhaps be ok. I would consult with Ben and Legal
[11:06] Juris Amat: see what they think
[11:06] Sam Courtois. Esq.: All the credentialing means is taht someone offered evidnce that he or she is admitted to a abr somewhere.
[11:06] DanielPerry Laa: Sam - I agree but the Florida Bar counsel just two days ago intimated that a phine listing is more than simply a listing
[11:06] Gracie Selona: What about a simple link to a Real World professional profile?
[11:06] Juris Amat: i know what it meand to us...what it means to some random avatart is a completely different story
[11:06] Agenda Faromet: I agree, Sam. But the problem is that you have to pay for that listing.
[11:06] Juris Amat: means
[11:06] Sam Courtois. Esq.: You do not.
[11:06] DanielPerry Laa: a link to a real world profile might be ok
[11:06] Sam Courtois. Esq.: The lsiting is free.
[11:06] Tim Faith: here is what the bar association originally wrote when we started doing credentialing (I just copied and pasted to our current website): http://slbarassn.ning.com/forum/topics/credentialed-sl-bar-associat...
[11:07] Agenda Faromet: You have to pay for the credentialing.
[11:07] Sam Courtois. Esq.: You have to pay for the review.
[11:07] Ellen: But the credentialing is not .... right.
[11:07] Agenda Faromet: Right.
[11:07] Sam Courtois. Esq.: Someone ahs to verify it.
[11:07] Elizabeth: It's not the listing that is being paid for. I think that is the point. You are paying for someone to tkake the time to check out that you are a lawyer.
[11:07] Elizabeth: take*
[11:07] Elizabeth: can't type today.
[11:07] Elizabeth: lol
[11:07] Ellen: Seriously, though, it is a fundraising thing, because it does not take more than a few minutes to check online these days to verify a name
[11:07] Sam Courtois. Esq.: It dsoesn't cast much.
[11:07] Ellen: at least in New York State, it's a quick check at the Office of Court Administration website
[11:07] Elizabeth: it is like a dollar
[11:07] Agenda Faromet: Exactly, Ellen. So what you're paying for is the listing.
[11:08] Agenda Faromet: The /value/ is in being listed.
[11:08] Sam Courtois. Esq.: Not at all.
[11:08] Hector Cuprill Jr Esquire: What about a donation?
[11:08] DanielPerry Laa: PK, how about I compile some ethicsa info for us to review - considering a Google Plus community on Online Ethics - if interested, contcat me
[11:08] Hector Cuprill Jr Esquire: It can be changed to a donation
[11:08] DanielPerry Laa: OK
[11:08] Agenda Faromet: Of course it is. There is no value to me in someone looking my name up. There is a value to me in having my name listed, so someone else can see that I'm verified.
[11:09] Ellen: If I wanted to give someone else's name and claim that it is me, how would we really verify if it is me or not?
[11:09] Sam Courtois. Esq.: We cannot.
[11:09] Agenda Faromet: Haha, true. Hi, I'm David Boies.
[11:09] DanielPerry Laa: I'm Elvis
[11:09] Ellen: So the verification that we are providing is simply looking up a name.
[11:09] zenitram: at least you didn't claim to be Antonin Scalia
[11:09] Ellen: We aren't really verifying that the avatar is that person
[11:09] Elizabeth: THere's a little more to being verified than just looking up a name from what I have seen.
[11:10] Agenda Faromet: Nobody in this room would believe that I am Antonin Scalia.
[11:10] Sam Courtois. Esq.: The only thing that we can say is taht Elvis presented evidence to us that he is a member of a bart asscoaiion somewhere.
[11:10] Hector Cuprill Jr Esquire: Could we make copies in PNG of our Supreme Court Diplomas and attach these to the SLBA (an are designated for that?)
[11:10] ElizabethElizabeth laughs
[11:10] DanielPerry Laa: Pinterest maybe?
[11:10] Hector Cuprill Jr Esquire: area
[11:10] Sam Courtois. Esq.: WE need to have better ethical guidance.
[11:10] Elizabeth: You can do that in your offices for sure!
[11:11] Sam Courtois. Esq.: Daniel, can you take a look at that and speak to us about it at the March Meeting?
[11:11] DanielPerry Laa: Seems like ethics are major stumbling block ... agree we need better guidance
[11:11] DanielPerry Laa: Yes, will do so.
[11:11] Juris Amat: There may be a reason why that was never done. I do remember the creation of the credentialing process and it was extensive I cant believe this ground was not covered before. I would suggest contacting either Ben or Legal as ive said
[11:11] Sam Courtois. Esq.: Thank you.
[11:12] Sam Courtois. Esq.: Juris - can you do that for us?
[11:12] Hector Cuprill Jr Esquire: Businesses will have the same issues but from FLSA and IRS standpoints.
[11:12] Sam Courtois. Esq.: Contact past leaders and pick thier brains?
[11:12] Juris Amat: Sure Sam.
[11:12] Hector Cuprill Jr Esquire: It will all work out
[11:12] Sam Courtois. Esq.: Thank you.
[11:13] Sam Courtois. Esq.: Tim, please make sure that is on the agenda for the March meeting.
[11:13] DanielPerry Laa: March 9, right?
[11:13] Sam Courtois. Esq.: We are way past the hour.
[11:13] Agenda Faromet: I move we adjourn so we can go get lunch!
[11:13] Hector Cuprill Jr Esquire: Time flies when you are having fun at work
[11:13] Sam Courtois. Esq.: One (hopefully) quick comment, and then I will entertain a motion to adjourn.
[11:13] Gracie Selona: I second
[11:14] Agenda Faromet: TOO LATE
[11:14] Sam Courtois. Esq.: Hold on.'
[11:14] Agenda Faromet: SO MOVED MISTER PRESIDENT
[11:14] Sam Courtois. Esq.: Stop
[11:14] Sam Courtois. Esq.: I don't care.
[11:14] Sam Courtois. Esq.: This is important.
[11:14] Agenda FarometAgenda Faromet cries in a corner.
[11:14] Juris Amat: lol
[11:14] Ellen: Still here.
[11:14] Sam Courtois. Esq.: We are coming up on elections.
[11:14] Hector Cuprill Jr Esquire: :D
[11:14] Agenda Faromet: Elections are in June!
[11:14] Tim Faith: :(
[11:15] Sam Courtois. Esq.: Agenda has indicated to me that she will not be available for service on the exceutive committee.
[11:15] Sam Courtois. Esq.: We need to identify new leadership.
[11:15] ElizabethElizabeth smiles
[11:15] Sam Courtois. Esq.: som, eone whio has his or her act together, for a change.
[11:15] Sam Courtois. Esq.: Also we need to redouble our membership roster.
[11:15] Sam Courtois. Esq.: If anyone is willing to serve, plese let me know ASAP
[11:16] Sam Courtois. Esq.: OK- thank you.
[11:16] Sam Courtois. Esq.: I will now entertian a motioon to adjourn.
[11:16] Tim Faith: so mooved
[11:16] Sam Courtois. Esq.: second
[11:16] Agenda Faromet: Thirded
[11:16] Sam Courtois. Esq.: anyone?
[11:16] Sam Courtois. Esq.: opposerd?
[11:16] zenitram: call the question
[11:16] DanielPerry Laa: Elvis votes "aye"
[11:16] Juris Amat: aye
[11:16] Agenda Faromet: AYE
[11:16] zenitram: aye
[11:16] Sam Courtois. Esq.: The meeting is adjourned.
[11:16] Elizabeth: Aye
[11:16] Gracie Selona: aye
[11:16] Hector Cuprill Jr Esquire: aye
[11:17] Tim Faith: i thought he left the building
[11:17] Sam Courtois. Esq.: Thank you everyone.
[11:17] Ellen: See you all!
[11:17] Agenda Faromet: See you next month, boys and squirrels!
