We host websites and regions of land using Opensim.
We rented 2 servers to a group in Brasil. They have several websites and Opensim Virtual world like SL.
I get this email from someone who has been using our name in his ads in SL to defame our business. Now he sent this email.

Is this correct? Or is he just talking crap.

Subject: Final notice All headers
I am giving you this final notice that I intend to file suit in an
indiana court requesting that you cease acting as an accomplice to the
use of the name "lifesim" as with the domain lifesim.com.br which you
are currently hosting services for.

Should you take all of the following actions you will be held harmless:
1 - Demand that your client cease using the name lifesim.com.br in
conjunction with services you host for them, such as the server at IP
72.21.49.178
2 - Forward a copy of such corrospondence by postal mail or email
3 - Permanently desist from hosting any services in conjunction with
the name lifesim.com.br or any other confusingly similar name

Should you give such notice to your client that they must cease using
your services in conjunction with the domain "lifesim.com.br" and they
persist without action on your part to enforce these terms then you
shall be held fully liable.

I highly recommend that you give such notice and reply to me via
postal mail or email by thursday 26th june 2008.

Hi Frank - no one can give specific legal advice to you here, but in very general terms, domain names can be subject to suits on various IP theories. If you plan to handle this yourself (at least until and unless a suit) is filed, you might want to start by requesting clarification of what theory "Litesim" believes is can sue under and then doing some research about that theory on the web. If you are genuinely concerned about litigation in the short term, however, you may want to take this to a lawyer and have him or her take a close look at it now, as there may be options available pre-lawsuit that disappear once one is filed.
I think it is just alot of Hot Air.
